Iran, Afghanistan Ink Extradition Treaty

TEHRAN, April 4 (ICANA) – The provisions of the Iran-Afghanistan extradition treaty approved by the Iranian Parliament have been announced by President Mahmoud Ahmadinejad.

Under the treaty, either country will, upon the request of the other, extradite individuals who are wanted by officials in the other country for having committed crimes.

The extradition request applies to acts which are considered crimes under the laws of both countries, and which carry a penalty of no less than one year in jail.

The extradition request will not be accepted in certain cases, namely if at the time when the crime was committed, the individual asked to be extradited was a national of the country which has been asked to extradite him or her, if the crime was political or military, if the crime is within the jurisdiction of the country asked to extradite the offender, or if the crime for which the extradition request has been put forward is not punishable by law.

If either party accepts the extradition request, it will inform the other one of the time and place the individual is to be handed over, and let them know how long the person in question had been in detention before extradition.

If the extradited individual returns to the other country before the legal proceedings end, or before he or she serves the sentence, the person can be extradited again upon the request of the country he or she has fled.
